The Court of Appeal sitting in Benin, Edo State, on Saturday sacked Mr Moses Anaughe of the All Progressives Congress (APC) as the lawmaker representing Ughelli North Constituency ll at the Delta State House of Assembly.
However, the court declared Prince Eric Oharisi of the Peoples Democratic Party (PDP) as the rightful winner of the March 9 State Houses of Assembly Election in the area.
The appellate court upheld the judgement of the Election Petitions Tribunal which had earlier sacked Anaughe as the winner of the election since his party (APC) failed to filled candidate for the election.
Oharisi, who came second in the election, was declared winner and member-elect for Ughelli Constituency ll.
The court ordered the Independent National Electoral Commission (INEC) to withdraw the certificate of return earlier issued to Anaughe and subsequently issue same to Mr Oharisi who won the election on the platform of PDP.
It could be recall that the Supreme Court had sacked Olorogun Jaro Egbo who stood as the candidate of the party during the election and declared that Anaughe was the winner of the APC primaries for the area.
